Welcome to EzyForm/ ("Service"), operated by RedinBlack ("we," "us," or "our"). By accessing or using our Service at EzyForm.redinblack.net, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

Description of Service

EzyForm is a form creation and management platform that allows users to:

Create custom forms with an easy-to-use, mobile-friendly editor
Collect responses from form respondents
View and manage form submissions
Download responses and access premium features (with paid subscription)

Eligibility and Account Registration

Account Creation

To use our Service, you must create an account by providing a valid email address. You agree to:

Provide accurate and complete information
Maintain and update your information to keep it accurate
Keep your account credentials secure and confidential
Notify us immediately of any unauthorized access

Account Responsibility

You are solely responsible for all activity that occurs under your account. You may not:

Share your account with others
Create multiple accounts for fraudulent purposes
Use another person's account without permission

Age Requirements

Our Service does not have age restrictions, but users under 13 should use the Service with parental guidance and consent.

User Content and Ownership

Your Content

You retain full ownership of all forms, responses, and content you create or collect through our Service ("User Content"). By using our Service, you grant us a limited license to:

Host, store, and display your User Content
Process and transmit your User Content as necessary to provide the Service
Create backups of your User Content for operational purposes

This license terminates when you delete your User Content or account, subject to our data retention policies.

Form Responses

As a form creator, you are responsible for:

All responses collected through your forms
Compliance with applicable data protection laws
Obtaining necessary consents from respondents
Proper handling and storage of collected information

Respondent Content

When you submit a response to a form:

The form creator owns and controls the response data
Your submission is subject to the form creator's policies
You grant the form creator rights to use your response as intended

Prohibited Content

You may not create, store, or transmit content that:

Is illegal, harmful, or violates any laws
Infringes intellectual property rights
Contains malware or malicious code
Harasses, threatens, or abuses others
Contains spam or unsolicited advertising
Impersonates others or misrepresents affiliation

Acceptable Use Policy

Permitted Use

You may use our Service for lawful purposes to create forms and collect information with proper consent.

Prohibited Activities

You agree NOT to:

Use the Service for phishing, spam, or fraudulent activities
Attempt to gain unauthorized access to our systems
Interfere with or disrupt the Service or servers
Reverse engineer or attempt to extract source code
Use automated systems to access the Service without permission
Resell or redistribute the Service without authorization
Collect or harvest user information without consent
Violate any applicable laws or regulations
Create forms designed to mislead or deceive respondents

Sensitive Data Collection

While we do not restrict the type of data you can collect, we strongly advise against collecting sensitive information such as:

Health or medical records
Financial account information
Government identification numbers
Biometric data
Information about minors without proper consent

If you collect such information, you are solely responsible for:

Complying with all applicable data protection regulations (GDPR, HIPAA, CCPA, etc.)

Subscription and Payments

Free Plan

We offer a free plan with unlimited basic use, including:

Form creation and management
Response collection
Basic features and functionality

Billing

Subscriptions are billed through Poller.sh
You authorize recurring charges to your payment method
Prices are subject to change with 30 days notice
All fees are non-refundable

Cancellation

You may cancel your subscription at any time
Cancellation takes effect on the next billing date
You retain access to paid features until the end of the current billing period
No refunds or prorated credits for partial billing periods

Payment Processing

All payments are processed by Poller.sh. We do not store your payment information. By subscribing, you agree to Poller.sh's terms and privacy policy.

Service Availability and Modifications

Service Availability

While we strive for high availability, we do not guarantee uninterrupted access to the Service. We may:

Perform maintenance with or without notice
Experience temporary outages or disruptions
Modify or discontinue features

Service Modifications

We reserve the right to:

Modify, update, or discontinue the Service or any features
Change pricing with reasonable notice
Update these Terms at any time

No Warranty

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:

Merchantability
Fitness for a particular purpose
Non-infringement
Accuracy or reliability

Data and Privacy

Privacy Policy

Your use of the Service is subject to our Privacy Policy, which is incorporated into these Terms by reference.

Data Backup

While we implement backup procedures, you are responsible for maintaining your own backups of important data. We are not liable for data loss.

Account and Data Deletion

You may delete your account at any time
Data is retained for 14 days after deletion
After 14 days, all data except uploaded files is permanently deleted
Uploaded files are deleted during random cleanup cycles

Intellectual Property

Our IP

The Service, including its design, features, code, and trademarks, is owned by RedinBlack. You may not:

Copy, modify, or create derivative works
Remove or alter any proprietary notices
Use our trademarks without permission

Feedback

If you provide suggestions or feedback about the Service, we may use it without obligation or compensation to you.

Limitation of Liability

To the maximum extent permitted by law:

No Liability

We are not liable for:

Any indirect, incidental, special, or consequential damages
Loss of profits, data, or business opportunities
Service interruptions or data loss
Third-party actions or content
Your misuse of the Service

Maximum Liability

Our total liability for any claims related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or $100 USD, whichever is greater.

User Responsibility

You are solely responsible for:

Your use of the Service
Content you create or collect
Compliance with applicable laws
Damages resulting from your violation of these Terms

Indemnification

You agree to indemnify, defend, and hold harmless RedinBlack, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

Your use or misuse of the Service
Your violation of these Terms
Your violation of any laws or regulations
Your User Content
Claims by respondents regarding data you collected

Termination

By You

You may terminate your account at any time by deleting your account through the Service.

By Us

We may suspend or terminate your account immediately if you:

Violate these Terms
Engage in prohibited activities
Fail to pay subscription fees
Pose a security or legal risk

Effect of Termination

Upon termination:

Your right to use the Service immediately ceases
Your data will be handled according to our data retention policy
Paid subscriptions are non-refundable
Sections that should survive termination will remain in effect

Dispute Resolution

Governing Law

These Terms are governed by the laws of Bangladesh, without regard to conflict of law principles.

Jurisdiction

You agree to submit to the exclusive jurisdiction of courts in Sylhet, Bangladesh for any disputes.

Informal Resolution

Before filing any legal claim, you agree to contact us at hello@ezyform.app to attempt to resolve the dispute informally.

Miscellaneous

Entire Agreement

These Terms constitute the entire agreement between you and EzyForm regarding the Service.

Severability

If any provision is found unenforceable, the remaining provisions will remain in effect.

No Waiver

Our failure to enforce any right or provision does not constitute a waiver of that right.

Assignment

You may not assign these Terms without our consent. We may assign our rights and obligations without notice.

Force Majeure

We are not liable for failure to perform due to circumstances beyond our reasonable control.

Changes to Terms

We may update these Terms at any time. Changes will be effective when posted with an updated "Last Updated" date. Material changes will be communicated via:

Prominent notice on the Service
In-app notification

Your continued use after changes constitutes acceptance of the updated Terms.
